What are the bylaws?

The bylaws are the operating manual for the Apache Shores Property Owners Association. They define who is a member, how voting works, how the Board of Directors is elected and operates, and how decisions are made. They establish the annual maintenance fee, explain how additional assessments can be approved, and outline the Board’s authority to enforce deed restrictions, adopt rules, and manage common areas. In short, the bylaws provide the structure and procedures that keep the Association organized, accountable, and functioning for the benefit of all property owners.

This supplemental declaration updates how annual fees and assessments work for most sections of Apache Shores. It increases the annual maintenance fee to $100 per lot in the sections that approved it, allows the Board to raise the fee by up to 5% per year without a membership vote, and requires member approval for any increase above 5% or for any special assessment. Because Section 5 did not adopt the amendment, it remains at $35 per lot, and any funds collected above $35 in the approving sections are kept separate and used only for their benefit. The amendment also confirms that any new rules or fines must be approved by both the Board and the membership.
What are the Deed Restrictions?
The deed restrictions are in place to protect the character, safety, and long-term value of Apache Shores. They set clear standards for how property can be used and what can be built, including limits on the number and type of homes per lot, minimum home size, building materials, setbacks from roads and Lake Austin, and where mobile homes are allowed. They prohibit activities that would create nuisances, commercial operations, dumping, or industrial uses, and they require proper utilities and approved septic and water systems. The restrictions also establish utility easements, outline lakefront structure rules, and create the annual maintenance fee that supports the Property Owners Association. In short, the deed restrictions provide the framework that keeps the neighborhood residential, orderly, and consistent for all property owners, and they give the POA the authority to enforce those standards.
